Legal Battle: Maxime Bernier Fights To Stop Trudeau From Reinstating 'Unconstitutional Vaccine Mandates' (Exclusive Interview)

On September 19, 2022, the leader of the People’s Party of Canada (PPC), Maxime Bernier, will be in Federal Court to fight the government’s capricious federal mandates, which have prevented Canadians who are not “fully vaccinated” from traveling by air. Bernier has been prevented from fully participating in his political role by Orders issued by Transport Canada, under the instructions of Prime Minister Justin Trudeau.

Despite the federal government’s recent announcement that it would lift the Covid “vaccination” requirements for the public service and domestic and outbound Canadian travelers, Bernier is moving ahead with his legal battle to ensure Trudeau can not reinstate the unconstitutional mandates. 

Background

On October 30, 2021, Trudeau’s World Economic Forum-controlled government announced that anyone traveling by air, train, or ship must have received two of the Covid shots. The travel “vaccination” mandate has prevented approximately six million unvaccinated Canadians (15% of Canada’s population) from traveling within Canada and prevented them from flying out of Canada. As a result, Canadians cannot travel to help sick loved ones, get to work, attend university, visit family and friends, take international vacations, and live ordinary lives like other citizens.

With the implementation of these Orders, Mr. Bernier has been restricted from participating in democratic discussions and the electoral process. As the leader of the fifth largest political party in Canada, in 2021, Mr. Bernier flew more than 79,000 km for work purposes. As a party leader, Mr. Bernier must reach thousands of people each year and participate in various political, intellectual, and charitable activities in all regions of the country. Travel other than by air has been only reasonably feasible within a relatively limited radius of his residence in Quebec.

“The Covid-19 zealots are attempting to gag dissenting voices like mine by any means possible. One such tactic is to prevent people from meeting and organizing politically. The courts must put an end to this segregation,” says Mr. Bernier.

Constitutional Violation

The Justice Centre filed a legal application in Federal Court on behalf of Bernier for judicial review of Trudeau’s federal mandates, which they believe are discriminatory and a clear violation of the constitutionally protected rights of Canadians.

The legal group that was founded in 2010 as a voice for freedom in Canada’s courtrooms reports that the “Interim Order Respecting Certain Requirements for Civil Aviation due to Covid-19, No. 53 was first implemented on January 28, 2022. With few exceptions, the Order has prohibited persons who are not “fully vaccinated” from traveling by air.”

Besides the Charter providing mobility rights that allow Canadians to freely enter and leave the country and travel unhindered between provinces, the Charter also guarantees citizens equal access to political institutions, public debate, and the electoral process.

Mtre Samuel Bachand, primary counsel for the Justice Centre in Québec, notes,

Democracy is not the property of the vaccinated, nor is it some kind of reward for well-behaved children. All Canadians, of all political affiliations, must be free to travel. Canada is the only country in the developed world that has banned vaccine-free travelers from air travel, and yet we are supposed to be one of the most democratic countries in the world.

Bernier Discusses His Legal Fight

After a recent speech in Ottawa, RAIR Foundation USA had the opportunity to speak with Maxime Bernier. The PPC explained that his legal battle is not only meant to protect himself but all Canadians from Trudeau’s “mandates that were unconstitutional, illegal, unethical, and not based on science.”

Bernier mentioned the recent June 14 “little” victory that Canada suspended the vaccine mandates as they relate to federal workers and domestic and outbound international travel. However, mask mandates for travel remain in place.

At a press conference, Ministers claimed that all of a sudden, the science suggests the harsh rules could be eased, at least for now. However, they were ominously suspended rather than scrapping the mandates altogether. This decision to suspend the mandates leaves the possibility that they could be brought back in the future if a new variant is discovered.

With Bernier’s upcoming legal battle, he plans to ensure that Trudeau’s government will not be able to bring back any unconstitutional mandates. He explains,

I’m also doing that fight in the court. And that’s an important point because we don’t want these vaccine mandates to come back. So if we have a decision from a judge saying that all that was unconstitutional, the government, the Trudeau government, and provincial governments won’t be able to impose vaccine passports again.

Bernier is hopeful the court will return a decision in December that will set a “legal precedent, that will be good for every Canadian, every Canadian will be able, to travel freely by plane, by train or by boat in our country.”
