A 15-year-old girl, who suffers from severe mental retardation, was allegedly raped in a refugee home in Etampes, France, by a 12-year-old boy Afghani boy.
The police were alerted by the staff of the home late Thursday evening on January 13. A few hours earlier, the little girl was allegedly raped in the boy’s bedroom. “He offered the victim fifteen euros so that she would not say anything,” indicates a source close to the case. Instead, the teenager was taken to the hospital and placed in another home. Meanwhile, the Afghani boy stayed where he lived.
No prosecution before 13 years
At the time of the events, this Afghan child was the subject of a temporary placement order (OPP) by a children’s judge at the Bobigny court (Seine-Saint-Denis).
The rapist child cannot be the subject of police custody since he must be at least 13 years old. However, he was to be subjected to a behavioral examination, just like the victim, so that the investigators could obtain details on his mental health. Given his young age, the magistrate can only order educational measures.
As of September 30, 2021, a new law changed the rules for children who commit crimes or misdemeanors, reports Le Parisien. Before the age of 13, a child cannot be punished because it is believed that he does not necessarily measure the consequences of his actions.
