During a Senate Judiciary Committee hearing on Wednesday, Attorney General Merrick Garland stated that he does not intend to retract an October 4 Department of Justice directive vowing to target parents at school board meetings.
The DOJ directive was based fully on a September 29 letter signed by Viola M. Garcia, EdD and Chip Slaven, Esq. from the National School Board Association (NSBA). After much pushback, the NSBA stated on October 22 that they “regret and apologize for the letter.”
Despite the NSBA apology, Attorney General Merrick Garland is doubling down on his quest to persecute and intimidate parents.
Garland also denied knowing about a memo originating in Montana from the Acting United States Attorney’s office. The memo, acquired by RAIR Foundation USA (see below), discusses thirteen federal statutes that can be used against parents.
“In response to a nationwide rise in threats and acts of violence against our educational community, Attorney General Garland has directed the FBI and the US States Attorneys to partner with federal, state, local and tribal leaders to address the problem,” the Montona memo by Acting United States Attorney Leif M. Johnson wrote in part.
The letter went to all county attorneys and sheriffs, as well as the Montana Office of Public Instruction and the Montana School Boards Association.
Parents Committing ‘Heinous Actions’ Equivalent to ‘Domestic Terrorism’ and Hate Crimes
In the original letter, the NSBA requests federal government assistance in thwarting dangerous parents, stating in part:
As these acts of malice, violence, and threats against public school officials have increased, the classification of these heinous actions could be the equivalent to a form of domestic terrorism and hate crimes.
The Attorney General was evasive during the hearing, which addressed the assertion that parents are involved in a “disturbing spike” of “threats of violence” and harassment aimed at school boards and teachers, as reported at RAIR.
During a revealing exchange with Ohio Rep. Jim Jordan last week, Merrick Garland was incapable of backing up the claim that parents were engaging in violent behavior warranting federal government intervention:
Jim Jordan: “When did you first review the data showing this so-called disturbing uptick?”
Merrick Garland: “I read the letter and we have been seeing over time…”
Jim Jordan: “So you read the letter? That’s your source? Is there some study, some effort, some investigation someone did that, said there’s been a disturbing uptick, or you just take the words of the National School Board Association?”
Merrick Garland: “Well, the National School Board Association, which represents thousands of school boards and school board members, says that there are these kinds of threats. When we read in the newspapers reports of threats of violence…”
Coordination Between NSBA and ‘White House Staff’
RAIR made the following observation on October 21, which did not go nearly far enough:
The cynical may consider that the entire effort to shut down parents was a coordinated plot hatched well before the September 29th letter. The mounting pressure on schools to stop pushing mask mandates and the backlash against relentless onslaught of propaganda aimed at children is clearly dangerous for the left’s agenda. This author can imagine the Biden team, activists, teachers unions and the media scheming on how they could squash the movement.
It turns out that NSBA was in communication with “White House staff” in the weeks leading up to the September 29 memo. This information was retrieved by the organization “Parents Defending Education” via FOIA request.
But even more disturbing, the Federalist reported that “the administration rewarded the NSBA’s president [Viola Garcia] with a cushy education appointment just two days after she sent the infamous letter.”

The School Board associations of Missouri, Ohio and Pennsylvania cut ties with the NSBA in the wake of the September 29 letter. Citizens should ask the school board associations in their respective states to do the same.
The Montana Memo
As discussed, several Republicans mentioned a three-page memo from Montana based on the DOJ’s October 4th letter that discusses thirteen federal statutes that can be used against parents. The federal charges include “Repeated Telephone Calls” and “Repeated Harassing Communication”.
The Associated Press obtained a copy of the memo, but did not publish it.
During the hearing, Senator John Kennedy of Louisiana said:
I’m looking at this letter from one of your U.S. Attorneys from October this year, where he wrote to the Montana Attorney General, all the county attorneys and all the sheriffs in his jurisdiction suggesting ways that parents could be prosecuted…at school board meetings in accordance with your directives. And one of the suggestions made by your U.S. Attorney is parents can be prosecuted for repeated telephone calls. Not threatening anyone, just on the theory that repeated telephone calls could be harassment. Really?

Calls for Resignation
Senator Tom Cotton from Arkansas told Garland that he wanted to discuss the “outrageous directive siccing the feds on parents at school boards across America.” “This is shameful. This testimony, your directive, your performance is shameful,” Cotton said. “Thank God you are not on the Supreme Court. You should resign in disgrace,” he continued.
During the hearing, Senator Josh Hawley of Missouri also called on the Attorney General to resign. Numerous Republicans, including Senators Ted Cruz, Ben Sasse, Marsha Blackburn and Chuck Grassley, questioned the Attorney General about the controversial memo, but Merrick Garland stood by it.

Judiciary Republicans signed a letter demanding that the DOJ memo be retracted. Citizens should loudly support this effort.

Garland lied under oath, he should be removed, arrested and prosecuted for his crimes.
Garland is just the last and latest example of Democrats who think they’re above the law and can come in front of Congress and lie. FBI, NSA, CIA, now DOJ come in front of Congress and lie with impunity.
Another problem is that when the federal government is complicit in violating the U.S. Constitution and federal laws, local governments that care about upholding the laws of the land step in and do what the federal government fails to do. Then the federal government and their judicial system turns around and sues the local governments for hundreds of millions of dollars for false discrimination, and false civil rights violations. They claim that those on the right are doing all of this for “entertainment value.” The left has no regard for the law unless they can twist and cherry pick it to suit their anti-American narrative.
Garland needs to be impeached. If not by Pelosi’s Congress then surely by the next.
Most of the statutes cited treat interstate actions. Nothing in federal law forbids the “interstate” behaviors described if they occur entirely within one state.
All State School boards should withdraw from the NSBA.
